Terms and Conditions
These terms and conditions pertain to the supply of all items or products (“goods”) by us (“seller”) to you (“buyer”) or an organisation you are representing, and you accept you are bound to these terms and conditions when:
You make an order on this website or over the phone, or
You make any type of payment to us, or
You accept delivery of, or any part of, the goods of an order.
Rights of Seller
We reserve the right to adjust the price, specification and description of any goods on the website at our discretion.
We reserve the right to withdraw any goods from the website at any time.
We will not be liable to the buyer for refusing to process and order or withdrawing any goods from the website.
We reserve the right to amend, change or update these terms and conditions as we see fit
Orders Pricing and Payment
All orders are deemed to be an offer by the buyer to purchase goods in accordance with these terms and conditions, and are subject to acceptance by the seller. We may choose to not accept any order for any reason.
The price of the goods is the price stipulated on noveltytoyworld.co.uk and noveltytoyworld.com. All prices displayed are exclusive of VAT and delivery charges.
The total purchase price, including VAT (if applicable) and delivery charges will be shown in the shopping cart and on the checkout pages.
Payment for goods must be made and received before the order is processed.
Where goods ordered are not available for whatever reason we will contact the buyer by email or phone to discuss substitution options, if this is not acceptable we will issue a refund for the goods that cannot be supplied and process the rest of the order where applicable.
You acknowledge that you can not rely on any representation, statement, promise, or guidance given on the website, by email, or by phone regarding the goods. Measurements and colours described in any product literature should be taken as approximations only.
We reserve the right to, at any time, discontinue, modify, or suspend any product advertised on the website or promotional material.
Any dates quoted for delivery or delivery date ranges are indicative only.
Goods supplied within the UK mainland will normally be delivered within 11 days of the order acceptance date.
Goods supplied outside the UK mainland will normally be delivered within 14 days of the order acceptance date.
We will endeavour to meet any date agreed for delivery, however we will not be liable for any losses, damages, costs or expenses incurred by the buyer arising directly or indirectly from any failure to meet estimated delivery times.
Delivery of goods shall be made to the buyers address as detailed in the order, and the buyer should make arrangement to take delivery of the goods for when they are confirmed for delivery.
If goods are returned to the seller in the event of non-delivery, the buyer will be notified by email or phone and redelivery costs will be the responsibility of the buyer.
Unless otherwise explicitly agreed the Seller reserves the right to affect delivery of the Goods in one or more instalments. Where delivery is effected by instalment each instalment shall be then treated as a separate order and failure by the Seller to deliver any one or more instalments in accordance with these conditions or any claim by the Buyer in respect of any one or more instalments shall not entitle the Buyer to treat the contract as a whole as repudiated.
The title and risk within the goods shall pass to the buyer upon delivery and the seller will not be liable for their destruction or loss arising from this point.
In the extremely unlikey event that goods are not received by the buyer within 22 days of the order date, or from the date upon which a new order date has been agreed, the seller must be notified by phone, email or in writing within 30 days of the order date, otherwise the seller has no liability for the goods.
Any damages, shortages or tampering due to delivery or carrier transit must be reported to us by email email@example.com within 2 days of the goods being received.
Cancellation and return policy
We don’t normally accept order cancellations, however, if we’re contacted by phone or email within 24hrs of placing your order, we may, depending on the circumstances accept a cancellation at our discretion. In the circumstance that we accept a return of stock (for reason except damage - see below), or cancellation of an order after we have dispatched the goods, a 10% restocking fee will apply, as well as charges to cover the initial and return postage fees.
The buyer shall inspect any goods received as soon as they have accepted delivery, and notify us by phone or email within 7 days of delivery if the goods are of incorrect quantity, damaged or defective. Any damages, shortages or tampering specifically due to delivery or carrier transit must be reported to us by email firstname.lastname@example.org within 2 days of the goods being received.
Where a defective or damaged goods claim is made the goods shall be returned to us by the buyer for inspection. If we have instructed the buyer to return said goods, the buyer will be refunded any delivery fees.
As we are a trade supplier, distance selling regulations are not applicable to purchases made on this website, over the phone or by email and generally do not accept returns. Our only obligation to the buyer is to: Replace or refund any goods that are damaged or defective; or to make good any shortage or non-delivery of goods, providing that the buyer has adhered to all stipulations detailed within these terms and conditions.
